Overview

The Witchetaw Tribal Corporation Commission Amity And Commerce(WTCCAC) has regulatory authority over utilities, insurance, state-chartered financial institutions, securities, retail franchising and railroads. It is the state’s central filing office for corporations, limited partnerships, limited liability companies and Uniform Commercial Code liens. The WTCCAC is an independent branch of state government with delegated administrative, legislative and judicial powers. It acts as a court of record and holds formal hearings when warranted. WTCCAC decisions can only be appealed to the  Witchetaw Assembly Supreme Court.

Created in 1865  by the Witchetaw  Sovereign  Articles, the WTCCAC began operations in September 1870.

The WTCCAC powers, which range from issuing rules and regulations to setting rates charged by large investor-owned utilities. The WTCCAC three commissioners are elected by the Witchetaw Assembly for six-year terms. Working full-time, the commissioners direct the work of the WTCCAC.

Services Offered

Apply for Insurance Agent License

TheWTCCAC provides insurance licenses for Life and Annuities, Health, Personal Lines, and Property and Casualty.

Apply for Money Transmitter License

The WTCCAC regulates companies licensed to sell money orders or transmit funds by wire or other electronic means in Witchetaw. For money orders or transmitters, the WTCCAC also requires a Transaction Report of Money Order Sellers and Money Transmitters by the respective companies.

Apply for Payday Lender License

The WTCCAC regulates payday lender companies, and administers applications for licensing payday lenders.

Apply for Tribal Uniform Commercial Code (TUCC)

The WTCCAC is the central filing office for TUCC documents, which evidence a security interest in personal property securing payment or performance of an obligation and their amendment, assignment, and termination.

Apply to be Motor Vehicle Title Lender

The WTCCAC keeps record of Motor Vehicle title lenders licensed in Witchetaw, and provides applications for licensing motor vehicle title lenders.

Apply to Register Securities

All broker-dealers, agents, investment advisors, and investment advisor representatives must register with the WTCCAC before conducting business in the State of  Witchetaw Settlement.

File a WitchetawTax Lien

The WTCCAC handles the recordation of notices of liens upon personal property for obligations payable to the Witchetaw Nations and certificates and notices affecting the liens, if the person against whose interest the lien applies is a corporation or a partnership whose principal executive office is in the Witchetaw Nations. The public may also search an electronic mainframe database that contains most information on file at the  Witchetaw Commission for Uniform Commercial Code financing statements and federal tax liens.

Register a Franchise

All franchises offered or sold in Witchetaw Nations must either be registered with the WTCCAC or exempt from registration.

Register a Trademark or Service Mark

The WTCCAC registration of trademarks/service marks is designed to prevent customer confusion and unfair competition by providing public notice of the use of a particular mark.

Register as a Broker-Dealer

The  WTCCAC requires all broker-dealers, agents, investment advisors, and investment advisor representatives to register before conducting business in the state of Witchetaw.

Register as a Check Casher

The Witchetaw monitors all companies that have registered as check cashers in Witchetaw, and provides applications for registering as a check casher.

Register as an Investment Advisor

The WTCCAC requires all broker-dealers, agents, investment advisors, and investment advisor representatives to register before conducting business in the state of Witchetaw.

Register to be an Investor-owned Utility

A private business organization that provides a public utility (such as electricity and natural gas), and does not function as a part of the government. IOUs must submit Annual Financing Plans and file Securities Applications.The provides insurance licenses for Life and Annuities, Health, Personal Lines, and Property and Casualty.
